When most people discuss CBD hemp oil extracts and creams, there tends to be general confusion about their legal status. That confusion is warranted as there is a lot of misinformation about the subject.

You can buy CBD products pretty much anywhere nowadays. From the local smoke shop to the pet store (yep, the family pet Fido can really benefit from it) to the convenience store around the corner.

Even with this accessibility, a lot of people are concerned as to what makes it legal.

The biggest confusion is the obvious misconception that hemp and marijuana are the same things. They aren’t – well technically, and that is the rabbit hole you go down when talking about CBD oil extracts.

We’ll explain the difference to give you a clear understanding of what makes these plants separate from each other from a legal standpoint. And that is what really matters here.

Is it legal for you to buy or not?

Let us take a few minutes and explain to you all you need to know about CBD hemp oil and cream. What they are, and the legal standing of this great product.

What is hemp and what makes it different from marijuana?

Let’s dive right in and get to the facts. Hemp and marijuana are the same, but different. They both come from cannabis, but there are two different kinds of cannabis – Indica and Sativa. Marijuana can be found in both versions while hemp can only come from Sativa, specifically “Sativa L”.

Now let’s get into what legally defines the two, THC.

THC is the psychoactive property that was so famously demonized in the 1936 film “Reefer Madness”. THC and the amount of it used is the legal sticking point for this entire discussion.

Hemp is legally classified as having less than 0.3% THC, making it virtually impossible to get high from. Marijuana is classified as having more than 0.3% THC in it.

That is it in a nutshell, hemp won’t cause a “stoned” effect while marijuana can, which makes it “illegal”.

So, can I legally buy CBD hemp oils and creams?

The H.R.5485 – Hemp Farming Act of 2018 decriminalized hemp and legally separated it from marijuana. It withdrew hemp from the Controlled Substance Act and took regulation of it away from the DEA and into the hands of the USDA.

This means hemp and the CBD extracts from it are federally legal in all 50 states. That is why you can now buy CBD hemp oil and cream for yourself, your elderly parents, and your pet.

So what does that mean on a state level?

Well, hold your hat because while it is legal on a federal level, the bill allows for states to regulate its production and sale.

So, what does that mean for you?

Well, unless you live in Idaho, Kansas, or Washington D.C. (which isn’t a state), you’re probably fine, but double-check before making any purchases.

Idaho will only allow for CBD hemp oils and creams that have 0% THC in them, which really doesn’t exist. Kansas limits its use for industrial purposes only. Washington D.C. for some reason considers any cannabis extract as hashish.

There are some states that require a patient registration, but for the most part, CBD hemp oil and creams are a safe, legal, effective choice.
